A closer look at state-by-state sports betting boom

The sports betting sector in the United States has dramatically transformed since the landmark Supreme Court ruling in 2018, which overturned the country’s federal ban. This decision has led to rapid industry growth. However, it has also resulted in a complex patchwork of state laws and regulations.

In 1992, the Professional and Amateur Sports Protection Act (PASPA) effectively banned sports betting nationwide, with Nevada being the sole exception. This changed in 2018 when the Supreme Court’s decision in Murphy v. National Collegiate Athletic Association struck down PASPA, giving states the autonomy to legalise and regulate sports gambling within their borders.

Following the ruling, numerous states seized the opportunity to legalise sports betting, leading to significant revenue generation and the creation of new industries. Some states have chosen to limit sports betting to brick-and-mortar establishments, while others have fully embraced online platforms.

A handful of states have opted to restrict sports betting to physical locations such as casinos rather than offering online or mobile wagering options. These states include Mississippi, Montana, Nebraska, New Mexico, North Dakota, South Dakota, Washington, and Wisconsin. While these states have legalised sports gambling, access remains limited compared to jurisdictions that have embraced a broader approach.

Since the Supreme Court’s decision, the sports betting industry carries on to expand at a remarkable pace. Online betting has gained immense popularity, with various operators offering services across multiple states. This growth has brought considerable economic benefits, including job creation and increased tax revenues. Despite the industry’s rapid expansion, major states like California, Texas, and Georgia have yet to legalise sports betting. These large potential markets continue to attract interest from betting operators eager to venture into these untapped markets. As the industry matures, market consolidation is anticipated, with a few dominant operators likely to emerge.

Regulatory and ethical considerations

The expansion of sports betting in the United States has brought regulatory and ethical challenges to the forefront with much debate. States are tasked with ensuring that sports betting remains a safe and fair activity for all participants. Most have set the minimum age for sports betting at 21, although some exceptions exist. Additionally, regulations require that online bettors be physically located within the state where the wager is placed, regardless of residency.

As the dynamic sports betting industry grows, policymakers and industry stakeholders must address a range of complex issues to ensure the market’s sustainability and responsibility. This includes tackling ethical concerns, preventing gambling addiction, and safeguarding consumer interests.
