The Dutch Gaming Authority (KSA) recently issued a penalty payment order against Winbet NV, an online gambling operator accused of offering unlicensed games of chance in the Netherlands. This move reinforces the KSA’s commitment to enforcing strict regulations and safeguarding Dutch consumers from unauthorised gambling activities.

Understanding dutch gambling laws and regulations

Dutch law strictly prohibits the operation of games of chance without a valid licence. This legislation aims to protect consumers and ensure that gambling activities are conducted responsibly. Operators are required to obtain a licence from the KSA to legally offer their services to Dutch players.

An investigation by the KSA revealed that Winbet NV was offering unlicensed games of chance to Dutch players through multiple online platforms. This discovery led to the issuance of a penalty order aimed at ceasing these illegal activities immediately.

The KSA’s investigation identified four websites connected to Winbet NV—galaxyspins.com, winnercasino1.bet, superb1.bet, and doctorspins.com. These websites allowed users to create accounts, deposit funds, and participate in gambling activities without adhering to Dutch regulations. The KSA imposed a penalty of $302,000 per week if Winbet NV fails to comply with the order, up to a maximum of $890,000. This financial penalty is designed to discourage non-compliance and signal the seriousness of the violations.

Investigation findings

The KSA’s investigation highlighted that users on the identified websites could effortlessly create accounts and deposit funds, which facilitated illegal gambling activities without the necessary safeguards. There were no restrictions in place to prevent Dutch players from participating in gambling activities on these websites.

By enforcing strict penalties, the authority aims to discourage operators from bypassing regulations. Just last week, the KSA issued a near-identical penalty to BlockDance BV for offering unlicensed gambling services through the websites bc.game and bcgame.lu. Despite initial attempts to block Dutch players, access was restored, leading to the penalty.

The penalties issued against Winbet NV and BlockDance BV underscore the KSA’s firm approach towards unlicensed operators. These actions send a clear message about the authority’s zero-tolerance policy.

As the gambling landscape evolves, the KSA will likely continue to refine its regulations and enforcement strategies. The authority’s ongoing efforts aim to create a safer and more transparent gambling environment for Dutch consumers.
